In law, according to Article 18-2 of the Law of October 11, 2013
As mentioned on the website of the High Authority for Transparency in Public Life (HATVP), lobbying or interest representation consists of actions aimed at “influencing public decision-making, particularly the content of a law or regulatory act, by entering into communication” with one of the public officials designated in this article. This legal framework specifies that any person or entity seeking to influence public authorities’ decisions in matters of legislation or regulation, through dialogue and interaction, falls within the scope of interest representation as soon as they engage in exchanges with public officials.
In addition, Article 1 of the Decree of May 9, 2017, provides further clarification on the nature of this communication, establishing that the initiative must come from the interest representative.
This decree also details the types of communications that are not considered lobbying, specifically excluding certain incidental interactions or those that do not have a direct impact on public decisions. It thus clarifies the boundaries of interest representation under the law.
From these provisions, it emerges that to be qualified as an interest representative or lobbyist, two conditions must be met:
The Organic Criterion: This refers to the status of the individual or entity concerned, which must operate within an institutional or private framework and have interests to promote.
The Material Criterion: This relates to the activities carried out, which must aim to actively influence public decisions.
The combination of these two criteria—status and actions—is therefore crucial in determining whether a person or organization falls under the category of interest representatives.
